Terms and Conditions
The terms of use for the services offered by Trustnet Solutions SRL through the www.trustnetsolutions.ro website. Please read them carefully before placing an order.

Art. 1 This document contains the "Terms and Conditions" for the use of the services offered by Trustnet Solutions SRL through the www.trustnetsolutions.ro website. For the normal operation of our systems, we establish a series of rules that protect customers, including yourself.
Art. 2 These terms have the value of a contract and are governed by:
- GEO no. 34/2014 on consumer rights in contracts concluded with professionals (replacing the former G.O. no. 130/2000);
- Law no. 365/2002 on electronic commerce, which establishes the legal validity of electronic contracts.
II. Subject of the contract
Art. 1 Trustnet Solutions SRL provides website hosting, domain registration, SSL certificates and other web services ordered through the website. All customers accept these Terms and Conditions.
Art. 2 The provider reserves the right to modify, change, remove or add terms and conditions, without prior notice. Continued use of the services constitutes acceptance of the changes.
III. Orders, payments and invoicing
Art. 1 Orders are placed online. Customers must enter complete, correct and truthful information. The provider is not liable for inaccurate information supplied by the customer.
Art. 2 After the order is completed, a proforma invoice is sent by email. This has no fiscal value.
Art. 3 Customers must make payment in advance, within 5 business days of the date the proforma invoice is issued.
Art. 4 After payment is confirmed, the tax invoice is issued.
Art. 5 Tax invoices are sent by email in PDF format. Signing and stamping are not mandatory, in accordance with Art. 319 of the Fiscal Code.
Art. 6 Services are activated within a maximum of 24 hours from payment confirmation; as a rule, services are activated automatically within a few seconds.
Art. 7 Suspension: hosting accounts are suspended 5 days after the due date if they are not paid. VPS and dedicated servers are suspended 3 days after the due date.
Art. 8 Deletion: hosting account data is deleted after 30 calendar days from the due date if it is not paid. For VPS and dedicated servers, the term is 3 calendar days.
Art. 9 Reseller accounts receive non-billable cPanel accounts, as follows:
- RESELLER 1: 20 accounts;
- RESELLER 2: 40 accounts;
- RESELLER 3: 50 accounts.
Art. 10 Reseller accounts that exceed the limit pay $0.45 / account (excl. VAT) upon renewal.
IV. Domain registration
Art. 1 When purchasing a hosting, VPS or dedicated server service paid for a minimum of 12 months, customers can register a domain with the .com, .net, .org or .info extension free of charge. The first renewal is paid annually. The registrars' terms apply.
Art. 2 Rules for registering international domains:
- .COM — domains for commercial purposes. ICANN - COM rules apply.
- .NET — domains for networks, general or commercial. ICANN - NET rules apply.
- .ORG — domains for organizations or commercial. ICANN - ORG rules apply.
- .BIZ — domains for businesses or commercial use. ICANN - BIZ rules apply.
- .INFO — domains for general purposes. ICANN - INFO rules apply.
V. Guarantees and refunds
Art. 1 Customers are entitled to a full refund for hosting services within 30 days of placing the order. The request is sent to vanzari@trustnetsolutions.ro. The refund is made, as a rule, within a maximum of 24 hours from receipt of the request and, in exceptional cases, within a maximum of 30 business days.
Art. 2 Excluded from the 30-day guarantee are:
- domain registration fees;
- fees for dedicated and virtual servers;
- services ordered as a reseller;
- fees for optional services other than those in the standard offer.
Art. 3 Services paid by SMS can only be returned to the customer account, as credit, and refer strictly to web hosting and web reseller services.
Art. 4 The guarantee does not apply to the extension or renewal of web hosting services.
Art. 5 The guarantee does not apply if the account has breached these Terms and Conditions.
VI. Use of services
Art. 1 The services are used only for legal purposes. It is forbidden to transmit information that violates the law of any state or city. Pornography and material of a sexual nature are prohibited on Trustnet servers.
Art. 2 The provider reserves the right to delete or block access to the content on the site, without notice. Access is restored after the situation is brought into compliance.
Art. 3 For reseller accounts that breach the rules, we reserve the right to suspend the account without informing the reseller in advance.
Art. 4 The following illegal material is forbidden:
- pirated software;
- streaming sites;
- spam / unsolicited messages;
- pornography, nudity or adult content;
- torrent sites;
- hacking / cracking;
- proxy / IRC scripts;
- PhpShell;
- scripts with security vulnerabilities;
- warez / copyright-protected MP3s;
- copyright infringements;
- material that is illegal or contrary to public policy;
- pages containing links to material that may be considered harmful;
- any sexual or obscene content.
The provider will be the sole arbiter of what constitutes a breach and reserves the right to deactivate the account at any time, for any reason, without a refund.
Art. 5 Spam, or the sending of unsolicited messages from Trustnet servers, is STRICTLY forbidden. Pages that breach our anti-spam policy will be deactivated immediately, without the right to a refund.
A message is considered SPAM if:
- it contains phrases such as "This email cannot be considered SPAM";
- the sender's details are incomplete;
- the recipient's consent cannot be demonstrated;
- the unsubscribe (opt-out) procedure does not work;
- it uses purchased or exchanged lists;
- it is sent from another server.
Any complaint received in this regard and confirmed will lead to the immediate suspension of the account in question.
VII. Use of resources
Art. 1 Accounts are monitored for resource consumption. If a very large amount of resources is consumed, the customer is contacted. Accounts that consume a far too large amount of resources (memory, processor, processes, disk space, bandwidth) may be suspended without prior notice. Shared Hosting services do not accept heavy resource consumers.
Art. 2 Customers can request a package upgrade or a temporary increase of the allocated resources. It is the customer's responsibility to contact us in time.
Art. 3 The use of excessive amounts of server resources is forbidden. These include traffic bandwidth, processor usage and/or disk space.
Art. 4 If a customer uses more than 25% of the system resources for a period longer than 90 seconds, the provider reserves the right to suspend the hosting account without any notice.
Art. 5 If cron-type scripts run for more than 10 minutes, they will be disabled without any notice.
Art. 6 Hosting and reseller packages cannot host files larger than 500 MB in size, including log files. The following are forbidden: radio/video streaming, file sharing, image sharing, free hosting, backup and WordPress MU.
VIII. Use of storage space
Art. 1 The provider offers packages with unmetered storage space and bandwidth. The resources are used for legitimate web content, so that visitors can view it. The files within a domain must be part of the active website.
Art. 2 Sites must not contain backups, downloads or other content of this kind. We will treat all password-protected archived files (e.g. zip and rar) as unacceptable. Audio/video multimedia content is acceptable if it is streamed to the user, but links to downloading via HTTP are not acceptable.
Art. 3 On the Professional plan we offer unmetered disk space; however, the disks in the servers are not unlimited, so the customer may become limited if a hard disk starts to fill up.
Art. 4 — Inode usage
Art. 4.1 An inode is a data structure in a traditional Unix-style file system. It stores basic information about a regular file or a directory. The total number of inodes represents the total number of files: the website, the emails (each email means one file) and the system files.
Art. 4.2 The provider limits the number of inodes as follows:
- Starter: 480.000;
- Clasic: 480.000;
- Advanced: 580.000;
- Professional: 920.000.
Art. 4.3 VPS and dedicated servers are not included in this limitation.
IX. Restrictions
Art. 1 The provider reserves the right to impose hardware and software restrictions without prior notice, for known security issues.
Art. 2 Emails are limited to 400 messages per hour.
Art. 3 On the CloudLinux system, the packages are limited as follows:
- Starter: maximum 100% CPU core, 30 entry processes (EP) and maximum 1 GB RAM;
- Classic: maximum 150% CPU core, 40 entry processes (EP) and maximum 1 GB RAM;
- Advanced: maximum 250% CPU cores, 50 entry processes (EP) and maximum 2 GB RAM;
- Professional: maximum 300% CPU cores, 60 entry processes (EP) and maximum 3 GB RAM.
Art. 4 An account cannot consume more than 10 MB/second.
X. Backup
Art. 1 Web hosting includes a backup service every week, but it is performed for administrative purposes only and IS NOT GUARANTEED UNDER ANY CIRCUMSTANCES.
Art. 2 Customers are responsible for maintaining their own backups.
Art. 3 Trustnet Solutions does not offer any compensation for lost data. We will do everything we can, but we assume no responsibility.
Art. 4 Accounts that exceed 5 GB of allocated space are excluded from the backup system. The customer must create the backup manually.
XI. Customer responsibilities
Art. 1 The customer is responsible for updating the contact information in the control panel. We cannot be held liable for any confusion arising in communication.
Art. 2 If the details cannot be modified, the customer contacts the support department through a ticket.
Art. 3 The customer is responsible for maintaining the security of the username and passwords.
Art. 4 The customer is obliged to keep commercial or free scripts up to date (updated or patched) to the latest version. The update must be made within 24 hours of the Provider's notification. Otherwise, the Provider reserves the right to delete or block access.
XII. Limited liability
Art. 1 We cannot be held responsible for damages caused by the temporary unavailability of our servers, including damages resulting from the corruption or loss of data. The customer undertakes to indemnify us and hold us harmless.
Art. 2 The provider offers free technical support to all customers.
Art. 3 The provider is not responsible for the withdrawal of certain scripts offered for free and does not provide support for them.
XIII. Contract termination
Art. 1 The contract may be terminated:
- by the written agreement of both Parties;
- upon the fulfilment of one of the termination conditions set out in the Contract;
- when one of the Parties is in a legally provided state of impossibility.
Art. 2 Conditions for unilateral termination:
- a delay of more than 5 calendar days in making the payment;
- the discovery of fraud;
- the use of scripts/programs that may cause damage to the servers;
- the customer may unilaterally terminate the contract whenever they wish.
XIV. General terms
Art. 1 If you are not satisfied, please contact us and tell us what the problem is. If it is not resolved and you wish to discontinue the service, you will receive the money for the web hosting services paid in advance. Payment for domain registration or other related services is not refundable.
Art. 2 We allocate all the necessary resources to investigating security breaches. Customers who breach these provisions may be held criminally or civilly liable.
Art. 3 For customers with multiple accounts or resellers, we reserve the right to suspend all accounts if the main owner seriously breaches the provisions.
Art. 4 We are the only ones entitled to judge what constitutes a breach. Non-compliance is grounds for suspending or deactivating the account.
XV. GDPR
Art. 1 Trustnet Solutions continues its alignment in order to comply with the General Data Protection Regulation 2016/679. As of 25.05.2018, the GDPR has imposed a single set of rules, repealing Law 677/2001.
Art. 2 The rights of data subjects:
- the right to be informed about how the data is collected and used;
- the right to access the data we hold about you;
- the right to request the rectification of the data;
- the right to request the erasure of the data;
- the right to request that marketing messages stop being sent;
- the right to request that personal data be sent to another controller;
- the right to lodge a complaint with the competent authorities.
Art. 3 The responsibilities of Trustnet Solutions:
- to store the data entered on the servers confidentially;
- to limit access only to the persons who work directly with the servers;
- not to sell or transfer the data to third parties;
- to take proactive measures to protect the data;
- to report any data breach to customers and authorities.
All prices published on this site are expressed in dollars, all taxes included. Payment is made at the BNR exchange rate on the day the proforma invoice is issued.
